1. Acceptance of Terms

By creating an account, accessing, or using our Services, you confirm that: (a) you are at least 18 years of age; (b) you have the legal capacity to enter into these Terms; (c) you have read, understood, and agree to be bound by these Terms and our Privacy Policy; and (d) you will use our Services only for lawful purposes.

If you are accessing our Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Services

Mother Nature AI provides an AI-powered health intelligence platform including:

• AskMN v3: Herbal medicine consultation, drug-herb interaction screening, toxicology assessment, and integrative health guidance
• Sylvia 2.1: Mental health and psychological wellness support, CBT/DBT skill delivery, stress and burnout support
• NutriGen 1.0: Nutrigenomics analysis, genotype-specific nutrition protocols, and dietary optimization
• Genlyy 1.3: Genomic variant interpretation, pharmacogenomics profiling, and clinical-grade genomic reports (partner access only)
• Holos AI Band: Wearable device for passive biometric monitoring and health data collection
• Free Tools: Clinical support utilities including lab result explainers, SOAP note assistants, and supplement interaction viewers
• Developer API: REST API access to our AI models for authorized integration partners

We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time with reasonable notice.

3. Herbal Medicine and Toxicology Limitations

AskMN v3 provides information about herbal medicine, botanical supplements, plant constituents, and toxicological assessments based on published scientific literature. This information is provided for educational purposes only.

• Herbal and botanical information does not constitute a prescription, recommendation to self-treat, or advice to discontinue prescribed medications
• Drug-herb interaction assessments are based on published literature and may not reflect all known or emerging interactions
• Toxicological assessments are informational and do not replace evaluation by a poison control center or emergency physician
• Individual responses to herbal preparations vary; consult a licensed healthcare provider or registered herbalist before use
• For poisoning emergencies, contact Poison Control immediately: 1-800-222-1222 (US)

4. Mental Health Services — Safe Messaging and Crisis Protocol

Sylvia 2.1 provides mental health support, psychoeducation, and wellness coaching. It is not a licensed mental health provider and is not a substitute for professional psychiatric, psychological, or counseling services.

• Sylvia AI follows safe messaging guidelines from the American Foundation for Suicide Prevention (AFSP) and the National Suicide Prevention Lifeline
• In the event of a detected crisis signal, Sylvia will provide immediate safety resources and escalation to the 988 Suicide & Crisis Lifeline
• Do not use Sylvia AI as your sole mental health support resource if you are experiencing a psychiatric emergency, active suicidal ideation, or acute psychosis
• Sylvia AI does not prescribe medication, diagnose DSM conditions, or replace therapy with a licensed mental health professional
• If you are in immediate danger, call 911 or go to your nearest emergency room

5. Genomic and Genetic Data Terms

If you use Genlyy or NutriGen and provide genetic or genomic data, the following additional terms apply:

• Genomic reports are for informational and educational purposes and are not equivalent to a clinical genetic test ordered by a licensed physician or certified genetic counselor
• Variant classifications (pathogenic, likely pathogenic, variant of uncertain significance, etc.) are generated in accordance with ACMG/AMP 2015 guidelines and are provided for informational purposes only
• Do not make decisions about medications, surgeries, or clinical interventions based solely on Genlyy reports without consulting a board-certified medical geneticist or clinical pharmacologist
• Pharmacogenomic profiles are educational and should be reviewed by a pharmacist or physician before any medication changes are made
• Genetic data is never shared with insurance companies, employers, law enforcement, or advertising companies
• You retain full ownership of your genetic data. You may delete it at any time through your account settings

6. User Responsibilities

By using our Services, you agree to:

• Provide accurate, current, and complete information when using our platform
• Maintain the security and confidentiality of your account credentials
• Use our Services only for lawful purposes consistent with applicable law and these Terms
• Not attempt to reverse-engineer, decompile, disassemble, or extract source code or model weights from our platform or AI models
• Not use our Services to generate, distribute, or facilitate harmful health misinformation
• Not attempt to circumvent crisis detection, safety filtering, or content moderation systems
• Not use automated scraping, crawling, or data extraction tools without written authorization
• Not share your account credentials with other individuals or organizations
• Not use our AI model APIs in violation of our API Terms (see Section 7)

7. API and Developer Terms

Access to the Mother Nature AI API is granted on a project-by-project basis subject to a use case review. By accessing our API, you agree to the following additional terms:

• API access is non-transferable and may not be sublicensed without written permission
• You must implement appropriate HIPAA safeguards if your application handles protected health information (PHI)
• You must comply with all applicable safe messaging guidelines when deploying Sylvia AI in consumer-facing applications
• Crisis detection and escalation features in Sylvia AI must not be disabled or circumvented in consumer deployments
• You may not use model outputs to build competing AI models or datasets without written permission
• You must attribute AI-generated content appropriately in patient-facing applications and include disclaimers that outputs are not a substitute for professional medical advice
• We reserve the right to revoke API access for violations of these terms or misuse of our models

8. Intellectual Property

All content, features, functionality, AI models, training methodologies, software, design elements, trademarks, and logos associated with Mother Nature AI are owned by Mother Nature AI Inc. and are protected by copyright, trademark, patent, and other applicable intellectual property laws.

You retain full ownership of all personal health data you submit to our platform. By using our Services, you grant us a limited, non-exclusive, non-sublicensable license to process your data solely for the purpose of providing our Services to you. This license terminates upon account deletion.

AskMN, Sylvia, NutriGen, Genlyy, Holos AI Band, and Mother Nature AI are trademarks of Mother Nature AI Inc. You may not use these marks without express written permission.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Mother Nature AI Inc. and its officers, directors, employees, agents, and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, physical harm, or medical harm arising from your use of or inability to use our Services.

Our total liability to you for any direct damages shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) US$100.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

10. Disclaimer of Warranties

Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy of medical or health information, or non-infringement. We do not warrant that our AI models will produce accurate, complete, or clinically appropriate outputs in every case.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of our Services shall be resolved by binding arbitration under the rules of the American Arbitration Association (AAA), conducted in New York, New York, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property infringement or breach of confidentiality.

Class action waiver: You agree to resolve disputes with us individually and not as part of a class action, collective action, or representative proceeding.

12. Termination

We reserve the right to suspend or terminate your access to our Services at our discretion with reasonable notice for violation of these Terms, suspected fraudulent activity, or risk of harm to other users. You may terminate your account at any time through your account settings. Upon termination, your right to use our Services ceases immediately and your data deletion will be processed according to our Privacy Policy.

13. Changes to Terms

We reserve the right to modify these Terms at any time. For material changes, we will provide at least 30 days' notice via email and in-platform notification before the new terms take effect. Your continued use of our Services after the effective date constitutes acceptance of the updated Terms. If you do not accept the updated Terms, you should discontinue using our Services and may request account deletion.
